Porter Horses Puppy Contract

When you purchase a puppy from me, you are agreeing to my contract whether you sign it or not. 

Contract between the seller, Porter Horses, and the Buyer, _________________________________.  Said puppy/dog is sold to buyer

A.  To the best of my knowledge, said puppy/dog is in healthy and sound condition at the time of sale.  Buyer has  72 hours from the time of delivery/pickup to have a vet check done on said puppy.  Vet check must be done by a licensed veterinarian.   Buyer is required to have a licensed veterinarian administer two more puppy vaccines to said puppy, parvo and distemper vaccines must be given at two-four week intervals following first vaccines given by breeder.  If buyer fails to have vet check done within 72 hours or fails to continue vaccines as stated above, the parties agree that any guarantee will be considered null and void.  Keep shot records from your vet.

B. All puppies/dogs are sold as PET QUALITY only, this does not mean they are, or are not show/breed quality. 

C. Health guarantee does not cover any parasite, internal or external as this is a treatable condition.

D.  Only untreatable, genetic diseases or defects will be considered.  Each case is dealt with individually. 

As the seller, I understand that the typical puppy buyer is not necessarily as experienced with raising puppies as I am.  If there is any concern at anytime with your puppy, please call right away for tips and advise.  Sometimes I can save un-needed trips to the vet.  I am always happy to share knowledge and advise on my dogs.  Also you can visit www.PorterHorses.com/medical_page.htm   to see my medical page that is full of basic information.

Seller is in no way responsible for any vet bills made after puppy/dog leaves the care of Porter Horses.  In the event that a problem should arise with said puppy, buyer should contact seller immediately.  Each case is dealt with individually as every situation is different.   Seller will not refund money in any situation.  Shipping is always the responsibility of the buyer, even in the event a puppy is to be sent back and/or replaced.  Any and all vet bills are the responsibility of the buyer.  NO exceptions.

All shipping costs related to any dog being purchased, as well as in relationship to any dog being replaced for any reason, are the responsibility of the buyer.  Seller shall not be responsible for death of said puppy/dog due to negligence or carelessness of any airline or other live animal carrier, it's agents or employees, or the buyer.

Any money placed on a puppy is non-refundable and non-transferable for any reason.

This contract is under the jurisdiction of the state of Oklahoma.  In the event of any dispute, the parties mutually agree that the dispute will be settled under the jurisdiction of Comanche County, Oklahoma. 
All parties mutually agree that all lawyer fees shall be paid by the buyer. 

In the event that a court of law finds any part of this agreement unenforceable, all remaining provisions not deemed unenforceable will be enforced to the full extent of the law.

This agreement sets forth the entire agreement between parties.  This agreement may not be changed, altered or amended except in a writing signed by both parties.

Please note: Any puppy that has not been picked up or shipped by 10 weeks is subject to a boarding fee unless otherwise discussed.  After this age, all expenses acquired for the purchased puppy are the responsibility of the buyer. 

A couple of questions taken from my FAQ page...

How can I send the deposit?	For deposits I accept checks, money orders or paypal.  For the final payment I accept money orders or paypal.  Or of course cash if puppy is picked up!  You can send paypal money to PorterHorseSales@aol.com or to my phone number 580-695-7711.
If I decide I don't want a puppy anymore can I get my deposit back?  What if I pick one I like better after I have already put a deposit on another puppy?	All money is non-refundable and non-transferable for any reason.  The reason for a deposit is for me to hold the puppy for you.  If I am holding a specific puppy for you, he can not be sold to anyone else.  If I was to transfer the deposit to another puppy, I would be loosing several potential sales while the puppy was marked sold.

ATTENTION!

    I don't take deposits on unborn puppies, you never know what you'll have and I price them all  individually.  (I take several things into consideration! Not just sex or color.)  Since I know you're wondering our prices start at $300 and go to about $1500.  We will take either half or $300 down (whichever is least). The balance will be paid when the puppy is picked up or before it is shipped.  We can accept credit cards through PayPal!  We accept other payment methods too!  You can see our past puppies for an idea of prices.  We are very fair and competitive with our prices.  When you buy them they are yours; I don't sell dogs on spay/neuter contracts.  All puppies come with ASDR papers.
